Privacy Policy rules

THE PIVOTOGO PRIVACY POLICY IS INCORPORATED AND MADE PART OF PIVOTOGO TERMS. IT CONTAINS IMPORTANT DATA THAT THE CUSTOMER SHOULD KNOW BEFORE CONTINUING TO USE OUR WEBSITE OR SERVICES. BY CONTINUING TO USE PIVOTOGO PRODUCTS AND SERVICES THE CUSTOMER SHALL BE DEEMED TO HAVE ACCEPTED THIS PRIVACY POLICY.

Pivotogo is committed to protecting the privacy of the information our customers share with us when accessing and using our websites, applications, products, events, services and other offerings (Services). This policy describes how we collect, use and share the personally data that our customers provide to us when you register on our services.

This policy may be supplemented by additional privacy terms or notices disclosed to customers in connection with their registration for or receipt of Services.

Changes in the Privacy Policy

Pivotogo wants their customers to be aware of what personal data is collected, how it is used, and under which circumstances Pivotogo may disclose said personal data. As further described below, all personal data that we collect and maintain shall be subject to the version of the Privacy Policy in effect at the time of such collection. If the Privacy Policy changes in any material respect, we shall not use the personal data the customer has submitted to us without our customer’s prior express consent in a manner that is inconsistent with the Privacy Policy in effect at the time that such data was collected.

Pivotogo reserves the right to change this Privacy Policy from time to time at its sole discretion, and shall prominently post any material changes to this Privacy Policy on the Website. If as a result of such changes, the customer wish to alter the ways in which Pivotogo is allowed to use our customer’s personal data, the customer can do so by following the procedure described in the Choices Available to The customer section of this Privacy Policy. The customer shall be deemed to have been made aware of, and shall be subject to, the changes to this Privacy Policy by our customer’s continued use of the Website after such notice has been posted for thirty (30) days with the following exception: if at the time the customer provide our customer’s personal data to Pivotogo the customer limit how such data may be used to communicate with the customer (either by Pivotogo or by third parties), Pivotogo shall not change our customer’s preference in this regard without our customer’s affirmative consent.

If Pivotogo sells assets (or the assets of a division or subsidiary) to another entity, or if Pivotogo (or a division or subsidiary) is acquired by or merged with another entity, the customer agree that Pivotogo may provide to such entity customer the data that is related to that part of our business that was sold to or merged with the other entity without obtaining our customer’s further consent. Pivotogo shall provide notice of such asset sales, acquisitions, or mergers on its Website.

LEGAL ISSUES

The Website is based in the Czech Republic and the Products and Services may be subject to the laws of various jurisdictions, including the laws of the European Union and other jurisdictions because access to the Website may use internet infrastructure of within different jurisdictions. For example, personal data collected in the European Union and its Member States is subject to the EU Directives concerning Personal Data, Privacy and Electronic Communications, including but not limited to Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of Personal Data and the Protection of Privacy in the Electronic Communications Sector and Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the Protection of individuals with regard to the processing of Personal Data and on the free movement of such data and the subsequent legislation adopted in the EU Member States.

Pivotogo may disclose our customer’s personal data without our customer’s permission if it has the belief that disclosure is reasonably necessary to meet any applicable law, regulation, legal process, or enforceable government request or to investigate or protect against harmful activities to Pivotogo guests, users, associates, or property (including the Website), or to others. Pivotogo also reserves the right to disclose such data in order to enforce applicable Terms of Services, including investigation of potential violations of the Terms of Services.

Pivotogo may be required by law enforcement or judicial authorities to provide personal data to appropriate governmental authorities. If requested by law enforcement or judicial authorities, Pivotogo shall provide this data upon receipt of appropriate documentation. Pivotogo may also provide data to law enforcement to protect its property and the health and safety of individuals as permitted by statute.

Browsing

The Website does not collect personal data from our customer’s computer when the customer browses the Website and requests pages from our servers. This means that, unless the customer voluntarily and knowingly provides us with our customer’s personal data, Pivotogo shall not know our customer’s name, our customer’s e-mail address, or any other personal data. When the customer requests a page from our Website, our servers log the data provided in the HTTP request header, JavaScript or similar technical tools, including the Internet Protocol number, the time of the request, the URL of our customer’s request and other data. We collect this data in order to make the Website function correctly and provide the customer with the functionality that the customer shall see on the Website. We also use this data to provide us with better understanding on how visitors use the Website and how we can better adjust the Website, its contents, and functionality to meet the needs of our users.

Third Party Websites

The Website may contain links to websites owned and operated by third parties. Such links are present for our customer’s convenience and data. Pivotogo does not control these third party websites and is not responsible for their privacy practices or content. Pivotogo does not control the data collection and distribution policies on such websites other than those that are under the control of Pivotogo itself. Content on third party websites may not reflect products, services, or data provided by Pivotogo. Third parties may also set their own cookies and/or use web beacons (defined below), which may be used to identify some of our customer’s preferences or to recognize the customer if the customer has previously had contact with the third parties. Pivotogo does not control the use of such technology by third parties, the data they collect, or how they use such data. The customer should direct all concerns regarding any third party website to the site administrator or webmaster of such sites.

Pivotogo also uses third party advertising companies to serve ads when the customer visits the Website. These companies may use general data about our customers visits to the Website as well as other websites in order to provide advertisements about goods and services of interest to the customer. If the customer would like more data about this practice and our customer’s choices as to not having our customer’s data used by these companies, please direct such concerns to the respective company's administrator or webmaster.

Data Collection

Most of the Products and Services offered to visitors of the Website shall require the customer to register for a user account with Pivotogo ("User Account"). When registering for a User Account, Pivotogo shall ask the customer to voluntarily supply Pivotogo with certain data about our customer by filling out and submitting an online form. Such data may include our customer’s name, phone number, credit card or other billing data, email address and home and business postal addresses. This is completely optional for the customer in order to register for a User Account or engage in activities requiring a User Account.

When ordering Products and Services via the Website, the customer may be asked to provide a credit card number, account and/or billing and shipping data enabling the consummation of the transaction. The foregoing data is collected and processed by online payment services, including but not limited to merchant accounts services, which we may utilize for payment processing, including automatic subscription renewals. In addition, as noted below, the minimum data is requested if the customer choose to subscribe to product updates.

The customer shall never have to answer any questions, and the customer may decline this exchange of data at any time. However, if the customer should choose to withhold requested data, we may not be able to provide the customer with some or all of the Products and Services. Depending upon the activity, some of the data that we ask the customer to provide is identified as mandatory and some as optional. If the customer does not provide any mandatory data with respect to a particular activity or purchase, the customer shall not be able to engage in that activity or make such a purchase. Pivotogo shall inform the customer of the mandatory and/or optional character of the request and/or required data.

Pivotogo shall only share our customer’s data with outside parties in ways that are described in this Privacy Policy or if we are required to do so by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law, cooperate with law enforcement agencies, or comply with a legal process served on the Website.

When the customer shall use the Website, Pivotogo or trusted third parties authorized by Pivotogo may also collect certain technical and routing data about our customer’s computer (also known as environmental variables) to facilitate our customer’s use of the Website and its services. When our customer’s browse the Internet, our customers’ Internet browser (such as Mozilla Firefox or Microsoft Internet Explorer) automatically transmits some data to Pivotogo every time the customer accesses content on one of our internet domains. Examples of such data include the URL of the particular Web page the customer has visited, the IP (Internet Protocol) address of the computer the customer is using, or the browser version that the customer is using to access the Website. All of this data may be collected by Pivotogo and used to help improve our offerings to the customer.

We use such data to facilitate and track our customer’s use of the Website and its services. Pivotogo also uses environmental variables to measure traffic patterns on the Website. Without expressly informing the customer in each particular circumstance, we do not match such data with any of our customers personal data.

The customer may be provided an opportunity to subscribe to a periodic newsletter and product updates. This newsletter is a marketing tool that allows Pivotogo to inform the customer of new Products and Services, updates, as well as other news relevant to the company. The subscription service requires the customer to provide our customer’s first and last name, our customer’s email address, and other data. Optionally, the customer are asked to provide the name of the company the customer represent. The customer is given the opportunity to choose the type of data Pivotogo shall provide to the customer and the customer shall be provided with an opportunity to opt-out from receiving such data by making appropriate choice in our customer’s User Account.

When the customer submits personal data to Pivotogo through the Website, the customer acknowledges, accepts and agrees that this data may be transferred across international borders and may be stored and processed in any of the countries in which Pivotogo and its affiliates and subsidiaries maintain offices or web hosting servers. The customer also acknowledges, accepts and agrees that in certain countries or with respect to certain activities, the collection, transferring, storage, and processing of our customer’s data may be undertaken by trusted vendors of Pivotogo. Such vendors are bound by contract not to use our customers personal data for their own purposes or provide it to any third parties.

Pivotogo may establish relationships with various service providers whose services may become available to the customer via the Website or via other websites that are linked to the Website. Typically, these providers shall offer services that Pivotogo customers might find useful, such as those that can be used in conjunction with Pivotogo Products and Services. In order to use these third party services, the customer may be required to provide personal data to such providers. Unless expressly provided to the contrary, personal data that the customer provide while the customer are visiting a provider's Website shall be subject to the privacy policy posted on that site, and personal data that the customer provide while on this Website in conjunction with a provider's service shall be subject to this Privacy Policy. For instance, the credit card and/or PayPal® data entered as part of the filling out a purchase form or registration process collected by a third party's registration and/or merchant services is subject to that third party's privacy policies. The customer should be aware that Pivotogo's agreements with these service providers often provide that they shall share with Pivotogo personal data collected from the customer. In such instances, Pivotogo may use this data in a manner consistent with this Privacy Policy.

Files

Pivotogo collects and stores the files the customer upload, download, or access via the Products and Services offered through the Website. We understand that these files may be confidential or contain sensitive data. Accordingly, Pivotogo does not share or permit third parties to access such files. However, no password-protected system of data storage and retrieval can be made entirely impenetrable. Although Pivotogo uses a number of security technologies and procedures to make sure that the data on the Website is secure, it may be possible for an unauthorized third party to access, view, copy, modify and distribute the data and files the customer store on the Website or via Products and Services despite Pivotogo's efforts.

User Account

As described above, the customer shall be given an opportunity to create a User Account containing our customer’s personal data. A User Account is required for using most Products and Services offered on the Website. Once the User Account is created, the customer shall be able to access, review and update our customer’s User Account data online via the Website.

If the customer wish to deactivate our customer’s User Account, the customer can do so through the User Account interface or by contacting Pivotogo. When the customer deactivate our customer’s User Account, all data stored and maintained as part of our customer’s account shall be deleted from our servers, including the files the customer stored via the Website or its Products and Services. The archived backup of our customer’s data shall be eliminated over the course of the ensuing regular backup cycle of Pivotogo. If the customer create an account, then the customer has the right to access and change our customer’s personal data and privacy preferences at any time by logging into our customer’s User Account, where the customer can view and make changes to our customer’s personal data.

Securing the Transmission and Storage of Data

Pivotogo is committed to protecting the security of our customer’s personal data. We use a variety of security technologies and procedures to help protect our customer’s personal data. Pivotogo operates secure data networks protected by industry standard firewall and password protection systems. Our security and privacy policies are periodically reviewed and enhanced as necessary, and only authorized individuals have access to the data provided by our users. Pivotogo takes steps to ensure that our customer’s data is treated securely and in accordance with this Privacy Policy. Unfortunately, no data transmission over the Internet can be guaranteed secure. As a result, while we strive to protect our customer’s personal data, we cannot guarantee the security of any data the customer transmit to us or from our online products or services, and the customer use these services at our customer’s own risk.

We treat the data the customer provide to us, including the Files, as confidential data. After personal data reaches Pivotogo, it is stored on a server with physical and electronic security features as customary in the industry, including utilization of login/password procedures and electronic firewalls designed to block unauthorized access from outside of Pivotogo. Our customer’s data is only accessible to those employees who perform technical support.

If a password is used to help protect our customer’s accounts and personal data, it is our customer’s responsibility to keep our customer’s password confidential. Do not share this data with anyone. If the customer are sharing a computer with anyone the customer should always log out before leaving any site or service to protect access to our customer’s data from subsequent users.

How Our customer’s Personal Data Is Used

Pivotogo collects our customer’s data in order to record and support our customer’s participation in the activities the customer select. We may use our customer’s e-mail address to send a confirmation e-mail and, if necessary, may use other data the customer provide to contact the customer for help to process the purchase or service the customer has selected. If the customer subscribe to a service or register a product, for example, such data is used to register our customer’s rights, if any, to technical support or other benefits that may be made available to registered users. Unless the customer opt-out, our customer’s personal data also may be used to keep the customer informed about new products, product upgrades, patches, special offers, and other products and services of Pivotogo and selected third parties if the customer has so opted to receive such communications.

Pivotogo recognizes and appreciates the importance of responsible use of data collected on this Website. Without our customer’s consent, Pivotogo shall not communicate any data to the customer regarding products, services, or special offers available from Pivotogo or its affiliates, although we may find it necessary to communicate with the customer regarding our customer’s use of the services on this Website. Except in the particular circumstances described in this Privacy Policy, Pivotogo shall also not provide our customer’s name to other companies or organizations without our customer’s consent.

Disclosure of Data to Third Parties

Pivotogo uses services of third parties, such as e-mail service providers, voice and messaging application ("VMA"), purchase, shipping and order processing merchants and marketing companies that act as independent contractors on behalf of Pivotogo. These parties are contractually prohibited from using personal data for any purpose other than for the purpose Pivotogo specifies or as otherwise allowed by the laws of applicable jurisdiction. We do provide non-personal data to certain service providers for their use on an aggregated basis for the purpose of performing their contractual obligations to us. We prohibit the sale or transfer of personal data to entities outside of the Pivotogo's affiliates for their use without our customer’s approval. Notwithstanding anything to the contrary herein, the customer hereby acknowledge and agree that third party services described in this paragraph are subject to such party's terms of services and privacy policies, links to which can be provided to the customer upon request as set forth in Section D of this Privacy Policy.

Pivotogo may disclose our customer’s personal data if we believe in good faith that we are required to do so in order to comply with applicable law, a subpoena, or other legal process. Pivotogo may also disclose personal data when we have reason to believe that disclosing this data is necessary to identify, contact or bring legal action against someone who may be violating this Privacy Policy, the terms of our customer’s agreements with the Company (such as the Terms of Service) or to protect the safety of our users and the public or under confidentiality and licensing agreements with certain third parties which assist us in developing, operating and maintaining the Website and its content.

Choices Available to the Customer

The customer can always choose whether or not to disclose personal data and that choice shall not prevent the customer from using the Website. Please note, however, if the customer should choose to withhold requested data, we may not be able to provide the customer with some of the services dependent upon the collection of this data and the customer shall be given an opportunity to "opt-in" and make our customer’s preference choices for any items that are optional and which are not prerequisite for our rendering such services.

The customer can choose at any time to opt out of receiving emails from Pivotogo or from having our customer’s personal data shared with selected companies. If the customer wish to opt out, the customer can do so by editing our customer’s User Account preferences with respect to e-mail or the sharing of data. If the customer elect to "opt out" we shall not, as applicable, share our customer’s personal data with third parties or send the customer emails. However, we may continue to use our customer’s personal data for internal purposes, to enhance our customer’s user experience or as necessary to administer the site or comply with applicable law.

We reserve the right to send registration and confirmation emails, and infrequent service alert messages to users to inform them of specific changes that may impact their ability to use a service they have previously signed up for, regardless of email contact opt-in status. We also reserve the right to contact the customer if compelled to do so as part of a legal proceeding or if there has been a violation of any applicable licensing, warranty and purchase agreements.

When the customer creates a User Account with Pivotogo and/or provides us with their e-mail address and other personal identification data, based on our customer’s personal preferences, Pivotogo may periodically contact the customer via e-mail and provide data about special offers and promotions that may be of interest to the customer. These communications shall relate to Pivotogo offers and/or the promotions of select, reputable third parties with whom Pivotogo has a strategic relationship because they offer products or services that we believe would be of interest to the customer. We may use a third party service provider to communicate with the customer. This service provider is prohibited from using our customer’s contact data for any purpose other than related to Pivotogo products and services. The customer may opt-out online by updating their User Account as described in the User Account section of this Privacy Policy.

To ensure that our customer’s request is honored, the customer must provide Pivotogo with data sufficient enough for Pivotogo to accurately identify and access customer records. The data we require is the customer’s full name, address and the email address that the customer has provided to Pivotogo when the customer initially requested services or products. Pivotogo reserves the right to contact the customer to verify that the customer has been accurately identified.

Cookies and Web Beacons

The Website uses "cookie" and "web beacon" technology. "Cookies" are short pieces of data generated by a web server that a website stores on a user's computer. Certain pages on our Website may require the use of a cookie for purposes of keeping data the customer enter on multiple pages together. Cookies also enable us to customize our Website and offerings to our customer’s needs and provide the customer with a better online experience with us. In addition, cookies are used to:

measure usage of various pages on our Website to help us make our data; more pertinent to our customer’s needs and easy for the customer to access;

identify and categorized the internet webpages from which the visitor came to the Website and observe the browsing patterns; and

provide functionality such as online orders, Pivotogo services and other functionality that we believe would be of interest and value to the customer.

The types of cookies that we use are referred to as "session" cookies and "persistent" cookies. Session cookies are temporary and are automatically deleted once the customer leave the Website. Persistent cookies remain on our customer’s computer hard drive until the customer delete them. We do not use cookies to gather data concerning our customer’s visits to other websites, nor ascertain any personal data about the customer apart from what the customer voluntarily provide us in our customer’s dealings with Pivotogo. Cookies do not, under ordinary circumstances, corrupt or damage our customer’s computer, programs, or computer files.

In addition, the service providers that Pivotogo use to serve and host our advertisements, and/or deliver our e-mails use session and persistent cookies, to track the number of times the Website is accessed and whether the site was accessed from an advertisement. There are no cookies in the advertisements or e-mails. A cookie is placed on our customer’s computer only if and when the customer clicks on an advertisement or opens an e-mail related to said advertisement. The cookie generated from the advertisement or e-mail does not contain any personal data and shall remain on our customer’s hard drive until the customer has delete it.

The customer may set their browser to block cookies (consult the instructions for our customer’s particular browser on how to do this), although doing so may adversely affect our customer’s ability to perform certain transactions, use certain functionality and access certain content on our Website.

Web beacons are used in combination with cookies to help website operators understand how visitors interact with their websites. A web beacon is typically a transparent graphic image (usually 1 pixel x 1 pixel) that is placed on a site. In contrast to cookies, which are stored on a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. These web beacons are not tied to personal data. The use of a web beacons allows the site to measure the actions of the visitor opening the page that contains the web beacon. It makes it easier to follow and record the activities of a recognized browser, such as the path of pages visited at a website. Pivotogo uses the data provided by web beacons to develop a better understanding of how the Website's visitors use the Website, and to facilitate those visitors' interactions with the Website. Pivotogo may make the aggregate data obtained from web analytics (including from our third party analyp>tics providers, if applicable) publicly available. If this data is made available, none of the data shall be personally identifying data or potentially-personally identifying data.

Consent

By using Pivotogo Services (for example, when you register for an account, purchase a product or service, enter a contest or promotion, communicate with us, or use interactive portions of our sites and applications), the customer consents to our collection, use and sharing of their personal data as described in this policy. In some cases we may also ask you to confirm your knowledge of the terms of this policy.

  1. PRIVACY-RELATED INQUIRIES AND COMPLAINTS Privacy-related inquiries

Pivotogo takes and addresses its users' privacy concerns very seriously.

If our customers believe that there has been an instance of non-compliance with this Privacy Policy with regard to our customer’s personal data or that the customer has other related inquiries or concerns, the Customer may write or contact Pivotogo by email at info@pivotogo.cz.

When sending Pivotogo an e-mail, please describe in as much detail as possible the nature of our customer’s inquiry or how the customer believe that the Privacy Policy has not been complied with to the fullest extent. Pivotogo shall investigate our customer’s inquiry or complaint promptly.

Please note that if the customer provides Pivotogo with inconsistent privacy preferences (for example, by indicating on one occasion that third parties may contact the customer with marketing offers and indicating on another occasion that they may not), Pivotogo cannot guarantee that the customers most recent privacy preference shall be honored.
